TERMS AND CONDITIONS

This web site (the "eTool"), including all text, data, information, recordings, graphics, images, icons and any other content (collectively, the "content"), is owned and operated by the Federation of Health Regulatory Colleges of Ontario ("FHRCO"). By using the eTool, you, the user agree to the following terms and conditions (the "Terms and Conditions"). If you do not agree to all of the Terms and Conditions, please discontinue your use of the eTool immediately.

1. THIS ETOOL DOES NOT PROVIDE PROFESSIONAL LEGAL OR PRACTICE ADVICE

The content of this eTool is provided for general information purposes only. The content is not intended to replace consultations with a health regulatory college, an employer/organization, or legal counsel. 2. PROPRIETARY RIGHT AND GRANT OF LIMITED LICENSE

This eTool and the content are the intellectual property of FHRCO unless otherwise noted and protected by copyright, trade-mark and other proprietary rights of FHRCO. Except as expressly permitted in these Terms and Conditions, no portion of the eTool or the content, including without limitation trade-marks, trade names and logos, may be reproduced in any form, or by any means, without prior written permission from FHRCO. Any unauthorized downloading, redistribution, retransmission, copying, modification, or commercial use of the content may be a violation of federal or other law and could result in legal action. Subject to the preceding paragraph, FHRCO grants to you a limited license to display, print and use the content of this eTool solely for your professional or personal non-commercial use. Such license is revocable by FHRCO at any time at the sole option of FHRCO. In consideration of this limited license, you shall ensure that all copyright, trade-mark and other proprietary notices are retained on any copy of the eTool materials in the same form and manner as on the original.

3. CURRENCY AND ACCURACY OF INFORMATION

FHRCO has used reasonable efforts to ensure the information provided on this eTool is accurate when posted. 5. LIMITATION OF LIABILITY

In no event shall FHRCO, its officers, Board of Directors, volunteers, or agents or any supplier of content mentioned on this eTool be liable for any losses, damages, claims, or expenses whatsoever including, without limitation, direct, indirect, incidental, and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption, resulting from the use, misuse or inability to use this eTool or the content, whether based on warranty, contract, tort or other legal theory, and whether or not FHRCO is advised of the possibility of such damages.

6. NON-CONFIDENTIALITY

Absent the use of encryption, the Internet is not a secure medium and privacy cannot be ensured. Information provided to FHRCO by virtue of this eTool will be received by FHRCO on a non-confidential basis. FHRCO recommends the use of appropriate security, antivirus, and other protective software. FHRCO further recommends that no identifiable personal health information be included in use of this eTool. FHRCO assumes no liability for the delay, failure, interruption, or corruption of any data transmitted in connection with this eTool and does not warrant that the eTool is free of infection, viruses, worms, or codes that manifest contaminating or destructive properties.

References or links to information from organizations other than FHRCO are provided for informational purposes only and do not constitute implied or express endorsement by FHRCO of that material. This eTool may contain links to websites and servers maintained by third parties over whom FHRCO has no control. These links have been provided solely as a convenience for users of this eTool and do not constitute an endorsement by FHRCO of the content of such third party sites. 8. JURISDICTION

This eTool is administered by FHRCO, which is located in Ontario, Canada. Any matter arising out of the use of this eTool shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without reference to its conflict of laws principles. You agree to submit to the non-exclusive jurisdiction of the courts of the Province of Ontario to determine any action or proceeding arising out of or in connection with this eTool.

9. GENERAL

These Terms and Conditions represent the entire agreement between every user and FHRCO regarding use of the eTool and its content. In the event a court of competent jurisdiction finds any provision of the Terms and Conditions to be unenforceable, the remainder of the provisions shall be unaffected and continue in full force and effect. The failure of FHRCO to enforce strict performance of any provision of the Terms and Conditions shall not be construed as a waiver of any such provision or right. You agree that your use of the eTool shall not violate any applicable local, provincial, national, or international law, including but not limited to any regulations having the force of law. If you have been found to have violated any of the Terms and Conditions, your use the eTool will automatically be terminated. You must immediately cease your use of the eTool and destroy any copies of the content or any portion thereof.

10. DISCLAIMER

This FHRCO Interprofessional Collaboration (IPC) eTool is intended to provide general information only. The material is not intended for and should not be used as a substitute for organizational or regulatory college rules, regulations, by-laws, standards, Acts, policies, procedures, or guidelines, and it is not a substitute for legal advice (for advice on your particular situation, please consult with your lawyer. This document cannot speak to matters of civil liability.) FHRCO may change the content of the eTool at any time without notice. These Terms and Conditions may be revised by FHRCO at any time without notice.
